1. Acceptance of Terms
Welcome to Paddle Party (referred to as “the Service,” “we,” “us,” or “our”), operated by Paddle Athletics LLC, doing business as Paddle Party. By using the Service or participating in our league, you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please refrain from using the Service.
2. Description of the Service
We offer a platform to facilitate connections between individuals interested in participating in Pickleball matchups within their local area. Our service is designed to match players with potential Pickleball partners for friendly games. While we do not directly coordinate specific locations or times for matchups, we provide the means for players to communicate and arrange such details independently.
3. Eligibility
The Service is intended for individuals who are 18 years of age or older. By using the Service, you affirm that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. User Responsibilities and Conduct
a. Respectful Communication and Sportsmanship: Users are expected to engage in respectful communication and exhibit sportsmanship throughout their interactions on the Service. Disruptive behavior, harassment, or abusive language will not be tolerated.
5. Third Parties and Partnerships
From time to time, we may partner with third-party services to enhance the league experience (“Third-Party Services”). By participating in the league, you consent to the sharing of data, including but not limited to player/team names, email addresses, and match results, with these Third-Party Services for the purpose of improving the league experience.
In the event that a partnership with a Third-Party Service is severed, we will make reasonable efforts to continue operating the league. However, players may no longer receive the benefits associated with the partnership, and certain features or functionalities of the league experience may be affected.
6. Liability and Safety
a. User Responsibility: Users acknowledge and agree that participation in Pickleball matchups carries inherent risks. Users are solely responsible for their safety and must adhere to all local laws and regulations while participating in matchups facilitated by the Service. The Service shall not be held liable for any injuries, accidents, or damages that may occur during or as a result of participation in Pickleball matchups.
7. Privacy and Data Usage
a. User Information: The Service collects and stores limited user contact information, including phone numbers and email addresses, for the purpose of facilitating communication regarding league participation.
b. Game Outcomes and Ranking: The Service stores data related to game outcomes to enhance matchmaking and improve competitive matchups.
8. Intellectual Property
a. Content Ownership: While most users may not contribute substantial content, the Service retains the intellectual property rights to any data or content submitted by users on the platform.
9. Termination
a. Our Discretion: The Service reserves the right to suspend or terminate user accounts at its sole discretion, without prior notice, if it is believed that a user’s behavior is detrimental to the community or violates these Terms.
10. Refunds and Exchanges
We appreciate your engagement with us and your commitment to our community. It’s important to note that our services are designed to provide you with opportunities for Pickleball matchups and connections within your local area. Given the nature of our platform and the resources dedicated to facilitating these connections, we want to inform you that there are no refunds or exchanges available for our services.
11. Modifications to Terms
a. Updates: These Terms are subject to change without prior notice. Users are responsible for regularly reviewing the most current version of the Terms. Continued use of the Service after any changes constitutes acceptance of the revised Terms.
12. Governing Law
a. These Terms shall be governed by and construed in accordance with the laws of North Carolina, without regard to its conflict of law principles.
13. Fourm Selection
a. You agree that any action relating to the service or any action filed by you against us concerning our performance under these terms will be filed in the state or federal courts encompassing the geographic area of Raleigh, Wake County, North Carolina.
14. Claims Limitation Period
You agree that any claim relating to the service or any claim filed by you against us concerning our performance under these terms must be filed within one (1) year of the accural of such claim.
15. Indemnification
You agree that any claim relating to the service or any claim filed by you against us is to be made against the company itself and not any of its agents: including but not limited to any officers, directors, employees, contractors, and owners (collectively referred to as “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of any other person or entity.
16. Class Action Waiver
You agree that any claim relating to the service or any claim filed by you against us concerning our performance under these terms must be filed on an individual basis only and you expressly waive your right to purse any class claims or to be represented as a member of a class.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under any applicable law, such provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect.
